To those that have dealt with Brian,

Everyone my name is Amy Torretto, my husband and I have been in the middle of a move and in the process we have been selling a lot of items and I just found this website tonight I apologize it took so long. I understand that my husband was selling some parts on this site and I wanted to let everyone know that your funds will be refunded back to your paypal accounts as soon as I can sort out a problem with paypal.
I will refund the money because a few days ago my husband Brian was in a car accident he was driving his Cuda and was rear ended by a semi and pushed into a guard rail. He is currently in the hospital, but in the crash the Carbs were smashed to pieces along with his Cuda. It is a miracle he is alive. I just wanted to let all those know who purchased from my husband so there wouldn't be anymore problems with paypal, they have suspended our account because someone filed a complaint. He wanted me to let you guys know what happened so no one thought he was trying to scam anyone. He is still in the hospital and already making plans to buy another Cuda and figured this forum would be vital in that.
Thank you all for your time and your money will be refunded as soon as I can get paypal to unfreeze our account.

To Amy or Brian(or whatever your name is?)
I see you were on here this morning, and you didn't reply to this thread?
Which makes me think you are a thief, the one thing in life I just F---ing hate.
Most thieves are not man enough to meet up with me,are you gonna try and hide too?
If so let me just clue you in on something,I will do my best to find you and deal with this.
I found the last two people who tried to rip me off(thanks to the internet and a few computer friends)
I suggest you prove your story(newspaper will have the accident in it)

Let's wait and see. I tried to buy something from Brian, I bidded $1600. I got an immediate reply that it was already sold, too bad.
If someone wants to rip off possible buyers, than I am an easy target because I'm from overseas. But he did not.

I don't know Brian or Amy in person. You may be right, and have to deal with a thief. But I just wanted to let you know.

Needless to say: If my wife or son really would be hospitalised, I would not react immediately.

I hope everyone will be ok. Financially and fysically.

great, Brian torretto, Brian O'Conner and Domonic Toretto are the names from the Fast and the Furious.  At least there isn't an Amy in the "Fast and the Furious."  Just curious, How many sent him money and for what?  And Brian Toretto could just be his handle.  Afterall, Scatterbrain isn't my real name.

I sent him 180 for shipping and the 670.  I don't wanna be an a$$, but I opened a dispute with Paypal just in case.  Everbody else may also want to do so, there are time limits in place that can expire and limit any chance you have for resolution.  Here is my email conversations with him.

Shipping is about 30 dollars I'm sorry I didn't include that. I will mail it out today if I can if not tomorrow for sure.

Hey Guys,
I'm a member of the A bodies only site and just registered here to give you a heads up. I received 2 emails today about this Brian Toretto because I HAVE THESE CARBURETORS FOR SALE ON THE FABO Site. He or she has copied my listing complete with pictures onto this site as well as on craigslist http://losangeles.craigslist.org/lac/pts/739742219.html (http://losangeles.craigslist.org/lac/pts/739742219.html)and possibly other sites. BUYER BEWARE of this person.

PS I asked the administrator of the FABO site to remove my listing so as not to be associated with this person.

Plot thickens.  Got this reply from Brian immediately after openning the Payal dispute this morning.  Never met a thief who would give a response, let alone one so quickly...

From Seller: Brian Torretto on 7/3/2008 09:58 PDT

Dear Antonio,
My account is now frozen I have no way to send the money back, I have been working, trying to refund all the money. I understand your frustration in not receiving your money and now I am being blamed for posting the Carbs up for sale all over the internet I have found 2 postings for the carbs on craigslist but when emailed the poster had a different email address. I am doing the best I can to solve this quickly and without pissing anyone off I understand your actions but all that was left in my paypal account last night was 67 dollars so obviously there is something fishy going on here. I am choosing the issue buyer a full refund but I do not know how well that will work considering all the pronblems with thsi damn account. Please let me know if it works. Thank you for your time and sorry for this fiasco.

This is what i recieved and sent back as a reply to Amy;

Dear hemiken,

Could you tell me what craigslist is? I opened the email today and there were 10 emails from people asking about a craigslist posting. There were also emails from earlier today from our email account talking to these men about selling the Carb. I have changed the password but could you tell me the other places you have seen my husbands Carbs for sale? I apologize , and I truly do not know what is going on, I have received emails and a phone call from paypal regarding trouble with fraud and scamming. I do not know what to do can you offer any advice?

Hello Amy,
The best thing you could do is let him sort out his own mess  take a laptop computer to him in hospital and make him fix everything.........  He should not have left everything up to you to do.  Best bit of advice is get a laptop to him
I am not up with craiglist, but i would make out a list and make sure he has not double sold the carbys to two different people.

Let me know how you go please.   And if the Paypal account can be rectified or Brian mentioned he had a freind who does Paypal, for a quick solution for people you guys have recieved money from ask Brian if his freind would mind re-imbursing the funds to the parties involved.  You should have a list by now.

Thanks,
Kenny.

I don't know if this helps, but anyone who bought from him could call Paypal and ask if they can check his past history?

Is he verified? How long a current member with Paypal? It may shed some light on the situation a little more on who they're dealing with.

I hope everyone comes out of this fine.

When I asked for the address to the hosp I had this in mind.  I just didnt want to come out and say it and risk sounding VERY insensitive.  But I fear that my suspisions were right on.  I mean it wont be hard to find this person if someone REALLY wants to find them.  Its a matter of $ vs. time vs. effort vs. motivation.  I HATE that this has happened.  This is not the kind of thing that c-c.c stands for and is a blemish on our way of life here.  Im feel very bad that someone has taken advantage of our system here.  It makes me sick to know we will now have to be so cautious in our dealings.... for what a couple hundred dollars this sucks.

Now that being said if Mrs. Toretto can provide some proof that her situation depicted here is real I will appolgize for my conclusions.  But... for now Im under the opinion that some of the members here have been ripped off!

this is bad.... I remember a while back on Moparts there was an exact type of email that ended up the same way as this one seems to be heading too. The seller was getting rid of stuff very quickly and priced just under what you would sell them for so it looked like he was in a desperate financial need. He collected a bunch of money and then no one heard from him, a week later his wife got on the forum and said her husband had a car accident and she would return the money..... It never happened..... it got UGLY real fast   :villagers:

I would like to know who purchased the disc brake and suspension set up from him.  That person is the one who really got stuck if he sent money to Brian.  I had contacted Brian and he said I could pay half the asking price of 1K for the kit and pay the other half upon arrival of the parts.  When I contacted him again to try to go through with the deal he said that the parts were already sold.  Seems to me that he could have still taken me for 500 bucks if he wanted to, but didn't.
So does anyone know who purchased the brake and suspension kit set up?

Just angers me so much to read this happening...been here for awhile now and it's so obvious it's "family" here...seems personal regardless who it happened to

 :villagers:

OK well it would help if Ross can retrieve the IP address...Alaska may just be another ploy and not the true place of residency. I have a system that can check IP's from a previous forum I use to supervise and am sure that Ross has access to the same...

Run the IP it will give important information...real name...possible address but also the provider who should be contacted as internet fraud is against the law and punishable and they may be able to help in locating this suspicious character

Am sorry to those of you that were tricked

To me he mailed that it was sold and picked up that saturday-night. It was on the craigslist too.

This is a bummer!! I've been reading through these postings and it smells rotten the more I read through it as more details on this guy come to light. One thing I did notice is that his "wife" Amy posted on July 2nd at 12:07am, that her husband was in a car accident "a few days ago" and the carbs were smashed in the accident and he is in the hospital. BUT, Brian placed a post on the Los Angeles (Central LA area) Craigslist on July 1st. These were for the same carbs that were "supposedly" smashed in the accident not to mention the fact that he would have had to post the listing from the hospital!!! I say SCAM!!!!  :villagers:

Evidence is pretty damning.  I escalated the claim to paypal for resolution.  Their resolution ability isn't as good as it used to be, but its better than e-golds.  I'll keep everybody here posted.

How long did you have to wait before it allowed you to change a dispute to a claim?  Paypal is saying that my dispute has only been open for 3 days to give it alittle more time and won't allow me to change my dispute to a claim.  Damian.

Dear Antonio Garcia,

We have concluded our investigation into your case and have decided in your
favor.

We were able to recover $63.03 USD and this amount has been credited to
you.  Please allow five business days for this adjustment to be posted.

If you are due any additional funds, we will make our best effort to
recover the balance from the seller.

If the seller's account has insufficient funds to complete the refund owed
to you, please be assured that we will take appropriate action against the
seller's account, which may include limitation of the seller's account
privileges.

Looks like I was first in line to get his money.  The last time I spoke with him when I first opened the case he said he had about $67 dollars in his account.  I just checked my paypal account and the money is already there.  Sorry Hemiken.

I agree that this is Bull$&%#,this is exactly why you pay for using paypal---security in the transaction.I think that if they don't take care of us all on this then people should let them know why they won't be using paypal anymore and I mean you should post everywhere you can on the internet so that they can take it in the pocket$$$$$$ where it will hurt the most. And if anyone can get me the real address of the scammer?please pm me the info and I will have him taken care of,He'll wish he was in an accident.

Man, I feel real bad for you guys that got swindled by this piece of crap!  :swear:  :stomp:  :pullinghair: .  At first I thought this guy was legit but it looks doubtful that he'll come through.

:iagree:  Maybe there should be a minimum # of posts that a person should have before being able to sell stuff here to help avoid this issue.  It won't completely solve the issue but mey help deter any "fly by night" sort of people.  At least they should have some time invested here.  Yes, it may prevent some good sellers from coming on the site but IMO is it worth it for good standing members to be preyed upon by people like this?

Will an IP address lead to an actual physical location?  :clueless:

It's really sad that our sense of trust on the forum has been violated.

Member wise,  How much money was lost to this guy?  Since we are family and things are tight all over, I would like to start a kitty fund to pay back the members that lost their money.  A few bucks from each of us goes a long way, and this act will actually show all the members here on CC.C what our club is all about.   Careing, trust, honor, respect , understanding, and fellowshipping. There is no member on this site more important than yourself.

If you have been taken for your money from this guy, post the total amount right here.  I will get this on a roll and start passing it out back to you as it comes in. I will use my paypal account as the revolving account to make sure everyone gets what they lost. This is not a lot of money, so members can do there part and just pitch in. We can keep posting the total and the payout untill we have resolved this issue and be over it..

We need to have a total of the money lost as to not over pay me into my account. Pay pal has there fees and I don't want to have to figure all that out in the refunds I may have to make back to you.  Once we know the total, I will pay every member that was ripped off, then I will take the rest and maybe have to divide it equally back to the members that donated. Some donated more then others, but the money returned back to them will be an equal share between everyone unless we can figure out a way to use the money for something else generated toward CC.C members and the club. Either way, I do not want any extra money in my pp account. I dont consider it mine and do want any type of reputation as being a person that would keep anything that isnt mine. I am only wanting to help the ones that had the misfortune of getting involved in this scam..

Kenny,Doug and Scatterbrain.

Please send me your pp account by pm. I just got in from a 100 mile trip taking my car to a show. I was nervous going that far. Didnt even take any tools. I decided i built it, it needs to be trusted.

If I read right when I re read the post from page one. You 3 members were the ones to get taken.

Kenny  150 plus 30 shipping
Scatterbrain   150 plus 30 shipping
and Doug 50 paid by ACGWINN

If this is right, the total is 410 bucks. I know I am close to having it all in my pay pal account now. I am waiting for my wife to give me back my hi spd broad band card before i go to pp. She is a mod on slingo and is almost through. When she is finished, I am going to send money when I get your PM's from you 3. I will also let everyone know how much we lack, which isnt much. While I was gone, i notice 2 more members sent 20 and 27.03. I will verify very soon who these people were and post them with the rest on Page 6.

I was asked by a member if we could send a card and the rest of the money to Brice since he had just went through a heart attack. I am for this if the members are willing to go along with the idea.....

I think we were about 15 or 20 bucks short not exactly sure yet. The pay pal charges messes with me on their deduction fees. I will promise everyone I will not keep one cent extra of this money

We only lack about 25 more dollars to have Kenny taken care of and my pay pal account less 25 for my donation. With this, everything will be back how it was before the posting and my money will be back like it was minus my donation. I still have to ship member slotts his gifts I donated to his son. But can use all of my money for Kenny just as soon as he sends me his Paypal address. Unless someone here can send me a pm with his pp address. Then it will go out to him now...

Hi Alan,

Count me in for the $25 to help out Kenny if you still need it.

I don't have a Paypal account so if you need me to contribute, please PM me you address so I can send out a money order to you. I'll make sure there's room in my mailbox for your PM.

Thanks for taking care of this, Alan, and to all the other great members here!!!

Hi Guys,

I would like to start by saying that i am overwhelmed and totally honored that you guys have gone to this much trouble for the three of us who got scammed..........   I have spent the last 15 minutes cathing up reading this thread alone, can not believe it had taken off like it did, i have been busy working silly hours and have not had time to read anything but personal e-mails and PM's.

Alan had sent me a PM asking for my paypal acc name, and i honourably declined with not even knowing what had been occuring in this thread. :faint:

I really love the nature, respect and even love (girly :eek4: ) from each and everyone of the members who keep contributing to everyone else here aswell, I find it hard to accept such a jesture for my own mistake :-[

Do not even know how to end this posting................................................................. :dunno:
I feel very rude in accepting under the circumstances, and yet i also feel extremely rude declining after reading how much trouble you guys have gone too.

If we dont look out for each other who will?  Its a lesson learned by all of us.  Pretty much we need to really know who we buy from.  I hate to feel that we have to discrimnate but it has now come to that in a way...  Members need to vouge for other members ect. confrimation is now the name of the game.  I just purchased some items from "Ohio Cuda" and I couldnt be happier!  I even left him some feed back in the feed back section maybe we need a safe sellers thread or something???

The bottom line is we are all family and we are here for each other, Im just glad we could help.

Don

The help I've gotten from the members of this Board while restoring my 'Cuda is worth many many times the measly amount I contributed for this. I'm sure the others feel the same way.

Didn't scumbag also place a second ad for Just Suspension kit for $1000?  It is listed as sold.  Perhaps he just used that as a bogus ad as bait. :dunno:  Hopefully no one got taken for $1G.  I haven't seen anyone say they lost money on that ad.

Kenny, you really dont have a choice in this matter. We have your money, we collected it for you and the other guys that got burned. The other guys got refunded, now you will be refunded. I either get a pm from YOU giving me your PP account or I go behind your back and get it. And think about this. Because I know you ,and how you are, as far as a giving man and a careing person. If it was any other member but you, you would of been the first to toss into the kitty. Well this time something happened where you were a victum of circumstance. Don't make us all feel bad by not taking what we did for you. We did this because we wanted to, not because we have to. Don is driving a car because we wanted to, not because we had to. And we never looked back. A kind act goes a long ways. If everyone started saying NOPE (phrase from Barry) and rejecting all the jestures we try to do around here, Cuda-challenger would not be what it is today. This is US , the site that believes in careing for the people that is in the hobby, not a fake mask. We are united together. You of all people know this. All afternoon yesterday I looked out my passenger mirror going down the road driving to a show. Each time I did, I was reminded of YOU and the special site I come to every single day. I am proud of this place and proud of the members that are regulars here. I have a bunch of stuff to send you now for your car, and I have your home address , so you can't refuse it :naughty: You really need to just accept what is going on and pm me now to wrap this all up. Then maybe we can get past this post and keep it archived as a reminder of what has happened and who we are and what we are known for. It has all came to full circle, now jump in and get this done....

Kenny, it is a done deal now. You may be sleeping, im not sure, but you now have an email from paypal waiting on you.

I would like to take time to personally thank everyone who took part in helping me make things right. As long as we all stick together and watch out for one another we can overcome any obstacle that happens to be in front of our blindness.

Thanks guys    ALAN

I do not know how, but this it the first time I have seen this thread.  :banghead:

I just want to say that I am sorry to those of you who were taken.  But I wanted to say how happy I am to see the members stepping up to help those.  I think I read that all of the money needed has been collected, but if there is anything more needed, I would be happy to contribute.  Please let me know.

Incase anyone is wondering, I helped Doug do a little IP snoping on this scammer, the results were less fruitfull then we expected, but we did locate the area where the scam came from and NO it was not Alaska....... I dont want to add anymore to this in case the jerk is looking in.....
Doug, anytime I can help, just ask, and now you know how to do your own searches, you are welcome and use it wisely.

Now that would've been funny if the Cuda was presented to Don and he said, "Gee, it's nice guys, but ah, no thanks..."   :scared: :roflsmiley:  :smilielol:

Well worded, Alan.  This IS a special site because of the actions and hearts or our members. The people here are giving/careing individuals.  People like that can often be the target of scammers, but let's not change our attitudes towards each other on the forum because of a few bad apples.  This is a great place to be.

Top Notch.

You guys know why you never got much back from Paypal .............................. cos they are part of those anus holes that run EBay.

............... and I agree. Minimum of 30-40 posts here before classifieds can be used by any new member. That will at least sort some of them out as they tr to make the $$$$ as fast as possible and move on.

Hi Guys,
I'm sorry you didn't find this guy, in a way he scammed me also by stealing my pictures to run his con. I agree with the 40 post rule that's been proposed and since I don't regularly frequent this site will abide by the suggestion. If anyone is still interested in these carbs I have them listed again on the FABO site with current pictures. The 750 Edelbrock, 670 Holley and 625 Demon are still for sale. Since there was no interest in the E85 QFT carb I didn't bother to list it again.
