Getting a new title

Hi all,
 Don't know if this the correct section for this question but here goes.

Am looking for a 70 Cuda project and via an inquiry about another car for sale I have found a Cuda for sale. Guy doesn't have the title but emailed me last night to say he has been down to the DMV and started the process of getting a title .

My question is what are the reasons the car would not have a title and is this a red flag warning me to avoid this car ?

I am an overseas member   :nzflag: and don't fully understand the process.

To get the car on the road here in NZ I need a clear title.

I will ask the seller why the car doesn't have a title but it would be helpful for me to have some independent info.

Seller doesn't own the car? Car doesn't have a valid vin# ? Bank owns the car? How about just a big scam? Now if I were looking at this with rose colored glasses: Seller misplaced the title, title was stolen, ex-wife got the car in a divorce settlement? The list goes on. Whatever your imagination will allow.

 We in the very early stage of sale, am in no rush and so not pressing too hard. Emailing only at present, when I talk to him I will be asking all the tricky questions. He has been doing the car up , have seen photos and 2 other projects in background. Mate thinks he got a convertible cuda under a cover, and viper in garage. If he brought these in accident damage condition do they still come with a title ?
 Hoping he brought car in good condition and previous owner lost title due to car sitting long time in shed .

Just have to wait, anyone here re-titled a car and know how long this takes ? May depend on what State you live in.

It could be a very simple issue. 

I have purchased cars that have changed hands many times and the title was simply lost to however many sellers ago.   Often cars are determined to be parts cars and people just don't pay attention to titles any more.

You can have the car and vin checked by a state patrol and at least cleared.  Then connect with one of many title companies to get a valid title.
 Or have the Feds go through their paperwork and get you a new reissued vin tag and title.   Much more detailed process. 

Both ways are legal.   Sometimes you can get lucky and joe's friend who he purchased the car from is still around.  Then buddy can go get the title from the department of motor vehicles for 20 bucks plus my kick in price.   

Lots of things can go correct with a lost title or vin tag car.  You just have to do the leg work to get it corrected.  Being over seas makes it more difficult.

Thanks for reply, as you say might be a simple reason, picture will be clearer once I have spoken to the guy. Said he has sold to overseas buyers before.

Car ticks most of my want boxes but not all, so not rushing in.

Obtaining a new title is very state dependent, here is Washington state there are a number of hoops to jump through. The big question is whether or not the seller ever had the title transferred into their name. If no (say it was bought as a parts car or something); then it becomes more difficult although not impossible by any stretch. Personally I would put this on the seller before any money changed hands, he has the burden of proof that it is his/her car and that they can legally sell it. Just because he/she bought it doesn't mean it wasn't stolen or otherwise contested. I have heard many horror stories of someone buying a car, then going through the process to get a title only to discover that somewhere down the line the car was stolen or sold by a family member who didn't have the authority to sell it. The problem here is that when the police research the VIN and should it come up as stolen, the car will be seized and returned. The new buyer is left with no recourse other than getting a lawyer.

Bottom line, you need the buyer to prove its their car and that they have the right to sell it. Since you are in NZ, you are a perfect candidate for a scam as the buyer hopes the car goes off shore and can't or wont come back to them. The rising value of these cars has made them perfect targets for people to make a quick profit and there are more than a few people who think that a car that looks abandoned is theirs to take and sell.

Point in case, a friend of mine was trying to purchase a vehicle that did not have a title, the seller swore it was their car and that the title had merely been misplaced. My friend contacted the DMV (prior to buying) as they will give you a name of the last registered owner (only a name and city, no address or contact info), he in turn did some internet searching and narrowed it down to 2 names, he called the first who stated they never owned such a vehicle however the second person immediately asked where the car was. Turned out that the car had sat beside an old gas station where the car had been taken for work but had closed down, the family meant to go and retrieve but were slow in doing so and when they did go the car was gone. They didn't file a stolen vehicle report as it was "just an old car" but they definitely wanted it. Long story short, my friend passed on the seller's information and the family got the police involved and retrieved the car, the family ended up selling the car (with a new title) for less money.

As the saying goes "buyer beware"... Not saying this isn't legit but I would definitely make the seller produce some documentation before I gave them a penny. You might lose out on a great car by pushing but that beats losing a pile of money on a bad deal. The seller can file for a lost title if it is in fact their car.

Some states don't issue titles for old cars.(bill of sale only) It's fairly common for people to buy an old car and never transfer or register the car. Could be a simple case of buying the car from a non title state and never getting around to getting a title. It's not nessesarily a deal breaker.

In California, I've brought many cars here with no title. People are irresponsible and lose them over the years. Often too lazy to hassle getting a replacement. It happens a heck of a lot more than you realize. As a buyer, I have made some killer buys because sellers know it's harder to sell without title and most buyers shy away.

In Ca, once it's out of the system a few years, it's like the car never existed. I personally check the VIN to verify what it is. I then run a check with AAA auto club and the local Highway patrol and verify it is not stolen or salvaged. If it comes back "not on file" then I'm good to go. I just take the car to the AAA office for my free VIN verification and they register it for me on the spot. I get my new title in a couple weeks. It's really that simple in many states.

Being that you are from outside the US, be EXTREMELY careful. Many countries will not allow you to import a car without a proper title. What you need to really play it safe is someone you trust to put eyes on the car, do all checks and verification, and then take possession for you to get the seller out of the way. Then the trustworthy person titles it for you and helps you with getting it on the boat.

I have sold a car to a guy in Germany and I was shocked at how vulnerable he was in the deal. Once the overseas seller has your money, they can screw you and there is absolutely nothing that can be done unless you're willing to fly over and deal with the matter personally. Never forget that banks will not reverse a wire transfer after the fact.
