Ok, here's my dilemma.

My girlfriend is in a divorced family, and her mother lives in florida.

She  doesn't mind so much going down there, but her mother wants her to stay for 5 or so weeks.
her parents tell her that she has to be sixteen to have a say in where she wants to be, but everyone else tells her that it's twelve.

does anyone know the definitive answer to this? I know this has nothing to do with cars, but I trust your guys' wisdom

Wow, always quite the shock when you move from 18yo+ boards to anyone can join boards...

I'm not sure where you're going with this from your post, but generally the parent with custody decides when and where the minor lives. A minor has no legal backing to argue a parent's will. Other than consensual sex with other minors and drivers licenses, no state allows for decision making by a child - a parent wants you to live in Syria, guess what, better learn to like sand.

To me it sounds like a family matter. Just an unbias friendly suggestion - As a boyfriend you might want to be very, very careful how you tread on others concerns because its very easy to have you legally removed from the equation.

There are laws about minors becoming emancipated. But I'm not a lawyer. Maybe somebody can touch on that subject here for you.

Like most other family / legal issues, it will probably depend on the state (s) laws pertaing to custody. And for that answer I would only accept the advise / answers a practicing lawer in that state would give you.

I know no law 1st hand but a Judge is who establishes custody based on the laws in his state.   Sounds like the dad has custody which usualy means the moms nothing to brag about.   So her dad has say so as to when & how long she stays unless there is something in her custody ruling that says otherwise.    Like others say KEEP YOUR NOSE outa this, it will get bit.

No one should touch this.  They would not want to be responsible if they tell you the wrong thing.  Contact McQueen Law Firm at 561-659-8810.  For a second opinion contact Bruce Rosenwater at 561-366-4839.  Both firms are in my area of FL. and 1 will most likely answer your question over the phone.  If they don't answer it I would suggest using a search engine to find family law attorneys in FL. that will give free consultation. A local Family law attorney in your area might be able to help you also.   Your girlfriends custody rules may fall under the jurisdiction of the state where the divorce occurred.  You need to let any attorney know the state in which the divorce was filed. Even when you do find the age you may have other legal hoops to jump through.  Knowledge can be a good thing; but use it and handle it properly. Good luck in your search.
