Although most of us would agree that going on to someone’s property with out their permission is unwise, if you look at the trespassing laws in most states, what was done was techically not trespassing.   

here are the basic laws for trespassing followed by most States;

purpose to injure - (which he did not) 
Prohibits entry on to any land whether open to the public or not for the purpose of injuring any property or property rights or with the intention of interfering, obstructing, or injuring any lawful business or occupation carried on by the owner, owner's agent, or person in lawful possession.

occupation - (his intent was not to occupy the property.)
Prohibits the entry and occupation of any real property whether open to the public or not without the consent of the owner, owner's agent, or person in lawful possession. Under this section, the property must be occupied for some period of time. 

refusal to leave private property - (Maybe, but he was nerver confronted by the owner and there where no sign stateing that trespassing is prohibited.) 
Provides that a person who refuses or fails to leave land not open to the general public when requested to do so by the owner, owner's agent, or a peace officer at the request of the owner or owner's agent may be arrested.

unauthorized entry of property - (The car was not stored in a building.)
Prohibits entry into any non-commercial dwelling house, apartment, or other such place without the permission of the owner, owner's agent, or person in lawful possession. This section is limited to structures which are used for dwelling purposes. 

Trespassing Penalties:
Trespassing (defiant trespasser) is a petty disorderly persons offense. The statute fits if the property is marked or fenced/enclosed, or notice against trespass is otherwise give. The maximum penalty for a petty disorderly persons trespassing offense is 30 days in jail and a $500 fine.

Trespassing is a crime in the forth degree if it is in a home or dwelling, a school, or a research facility. You can also be charged with a forth degree crime for peering into the windows of a home or dwelling. A forth degree crime conviction carries a maximum penalty of 18 months in prison.

I have many pic's and many stories that go with the pic's.R/T caused no harm to anyone or the car and if the guy didn't want people to see it,he should hide it.Now back to the car itself-----That Bird is so ugly,it's freakin awsome looking--and if I could do it,I would buy it and put it inside my living room.And I would love to know if its a 440/6 4spd dana car,because in that color it has to be some kinda rare bird.

This started out as a simple thread about a moment in time that doesn't happen very often anymore...that being the ' discovery ' of a special car from long ago . That's pretty simple no ? Seems some anally-retentive , monday morning lawyers have taken this way the f**k out of perspective . Do you take pictures at a car show without talking to the owner first ? Yes , that statement is not-related because of the circumstances...BUT , it's about as important as your statements about trespassing and the possible pratfalls ( I suppose if you live in the Appalachans and play the banjo on your front porch it might be relative ) AND as useless .

You can take your pictures and I'll take my pictures , I promise not to name you as a co-conspirator in any trespassing lawsuits that come my way...in the meantime , enjoy life and what it reveals to you .

Well put  :cheers:..............others should take note of their blown out of proportion attitude, and what it does to create negativity amongts a well mannered group of folks.
 I did not start this post to draw a line in the sand of what is right, and wrong. That was, and still NOT my intention.
I share this type of find here, because I know "most" will appreciate it, as it does not come around too often in this hobby anymore.
 Thanks vertman, so apparently what I have been accused of, was NOT trespassing by law  :swaying:

I heard it is a 440-6 also, but once again I'll have to pop the hood to verify this, if not I'm sure the fender tag that I plan on snagging for my rebodied Road Runner will tell me the proper code.
 To those who overreacted to my gesture of goodwill, I'll no longer respond. Enough time has been wasted in this thread explaining our morals, and the law.
Start another thread entirely devoted to this subject, if you'd like, and lets talk about the subject at hand here, can we?

I take it that you haven't gotten a chance to talk to the owner. It just su*** when a car like that is allowed to just rot. We should pass a law like the car crusher ones that says if you don't do anything in a year you have to sell.

Interesting to show the moral fiber of this board.

What you did was trespassing.  You went onto another person's personal property without permission.  That is illegal.  The definitions put fourth before do not pertain to personal property, but commercial.

Trespass to land is a common law tort that is committed when an individual intentionally enters the land of another without lawful excuse. Trespass to land is actionable per se. Thus, the party whose land is entered may sue even if no actual harm is done. In some jurisdictions, this rule may also apply to entry upon public land having restricted access. A court may order payment of damages or an injunction to remedy the tort.  If a person is found trespassing on said persons property, can be arrested and detained by government entity (police).

Wow!    :22yikes:   Looked at this thread when it was new and checked out the pics and didn't read it again for a while.  Checked back this evening and what a bizarre turn of events.    :faint:   Somehow the benign post train has severely jumped the tracks.  I'm shocked at these responses.  How did a post about a wing car find with a few pics turn into this?     :dunno:   Twilight Zone stuff going on in this thread..........    :clueless:    I'll leave now, hope it all returns to normal soon.........    :cheers:      :cooldancing:

By this definition, the person who knocks on your door looking for your neighbor or the kids in the neighborhood who are playing hide-n-seek and using your yard, can be arrested for trespassing?  Good luck getting a cop to do that.
