You can get a title and bill of sale. Just bill of sale or just a title.

I dont know if its a nationwide think (im probally about to look fairly stupid) but when i was at the DMV last week i got into a little convo with the girl at the desk who was training a new person and she said that cars 1972 and older do not have titles. Might just be a NY thing but im not to sure. If the title or registration does not match the bill of sale (assuming it was owned by one or two people who didnt register it or put it on the road) its more of a paperwork pain in the arse because you have to have bills of sale tracing how the car got to you. Personally, no matter how sweet the deal was, if the paperwork didnt match up, i wouldnt waste my time until the current owner got everything right on his end. Your the one spending the bucks on the car, make the seller get everything straightened out in his name so it saves you a headache later.

Must just be in New York because here in Michigan, every car should have a title.   :grinyes:

It really depends on the state where the car is located, and or titled. Some states don't provide a title for cars older than a certain year. If that is the case, make sure that the seller is willing to provide a notarized (in your presence) bill of sale. This will give you recourse in the event of a problem because the notary will request identification from both of you, and the guy won't be able to give you a bill of sale with a fake name on it. In some states, like PA, a title is absolute proof of ownership, and is mandatory. Without it, you can't do anything with the car, and you can actually get into trouble if you possess a car without a title. In the end, you need to satisfy the requirements of your government, while protecting yourself from buying a stolen vehicle.

ok so if the title is ownership papers are you allowed to sell a car to someone if the title is in someone elses name??? not the sellers name??? my boss has bought a model "a ford " that has a title but the title is in someone elses name and as its a running/ driving  vehicle , his brother in atlanta did the deal and  ??? ??? ???he is heading over there this sat to pack up the container inc my t/a to ship to australia.what does he do now?? my t/a does not matter according to us customs as it is a non running damaged vehicle so they basically consider it scrap metal , im just concerned that the customs wont let our container out of the us because the title shows one name and the reciept shows another name!does the title get transferred everytime you sell a car??? or only if the car is registered?? we dont want our container held up .does a car with a title mean that its not stolen or can you steal a title a sell a car??? how does an aussie know if its a genuine title or a made up one ?? im thinking this deal is a bit dodgey???im trying top find out more info as he will be there only 4 weeks and we need to find out before we present our paperwork to us customs for final approval. thanks guys oz

In Georgia you do not have to have a title if the car is over 10 years old. If a car has a title and was sold and the next owner did not transfer the title but only bought a tag and registered the car in his name, then sold the car a while later, the title process was skipped and Ga. DMV will not issue a title to the next owner. You can still register the car with a bill of sale and get a tag. The bill of sale is your proof of ownership. There are Title companies that can get a title later but I don't how that process works.

Again I think it depends on the state. In PA, you are not legally permitted to sell a car with someone elses name on the title, even if it has been signed, and you are not allowed to register a vehicle unless it is titled in your name. By law, both parties to the sale must be present, but absentee type forms can be used as long as Notaries perform all steps in the transaction.

If you contact one of the title companies, they will explain how it all works. Broadway Title is reputable.
