FREAKING ebay!

I recently sold an item on ebay.

I clearly listed the part number and quoted from the manufacturers site what models the part would fit (we are talking vacuum cleaner parts).

I noted that the buyer should double check that the part would fit their unit. I provided a picture clearly showing what the part looks like.

I also say very clearly that no returns are accepted.  The part I was selling was selling for less than half the retail value.

Then a couple weeks after the sale I get an email from the buyer saying "it doesnt fit" and asking for a full refund. I say that I accept no returns and then I get contacted by ebay saying the buyer filed a claim that I fraudulently sold the item.

I write back stating what I just stated, and they get back to me saying they will refund her money 100% but will not recouop it from me "at this time, considering the amount of money involved.".

WTF!

I replied like this:

While I do appreciate that I will not be charged back for this, will you be advising the buyer that you handled it this way (ie that I am not responsible for recouping her money and WHY?).

I think it is important that she know that you did not feel I was liable for this. The value of the item should have nothing to do with this matter.  There is a principle here.

In my opinion, the buyer has gotten away with a fraudulent "insurance" claim , and I don't think it is right.

If you refer back to it, my auction was extremely well labeled and clear; I noted in the title the specific part number, I noted in the auction where I got the application info, and I recommended that the potential buyer double check to make sure that the item fit their needs.  She bought a specific part number and she got that very specific part number, and she bought that part number in an auction that was VERY CLEARLY marked as "no returns". When I see these types of auctions, I always double check my application. With the web this is very easy to do.  If I am not certain that a part number works for me, I do not buy the item.

I really do feel that she made a mistake here by neglecting to check the model number of her unit FIRST. And then re-negg'd on the deal.  I have purchased things myself by mistake and in all cases I have kept the item and resold it or just made due with it if the seller didn't accept refunds.

I feel that all she did was pick a model # from my auction page  and claim that she has that model number, in the process filing a "fraudulent sale" claim against me.  Did she offer proof that she owns that model number unit? Of course not.  She made the (false) claim and now she gets her money back. Your paying her back 100% is reinforcing what she did. She gets all her money back, plus she keeps the item.

On top of this, she has not yet filed buyer feedback yet. If I file negative feedback (as I think I should since she has done what I think is wrong) I will in turn get negative feedback from her on this and that is not right. So, someone else will now get stung the same way.

How does this matter being handled this way affect me for the future?

Your letter states "but this time we will not be recouping funds from you....(we) would like to handle this claim for you                   in this manner as a courtesy".  This infers that I would be held liable if not for the amount of money involved. I feel this is a negative mark on my record.

 :iagree: I have had so many little problems like this with eBay.  The straw that broke it for me was how paypal now holds my $ after I sell something for 30 days! Now I refuse to sell anything on eBay with paypal.

That's crazy, and how do they know that it really is the wrong part? What if she did get the right part, and heard that if she did this Ebay would refund her money, and then filed a complaint to get her money back AND keep the right part? Insane.

Exactly.

well, I guess in the end I am not out anything, but sheesh.....makes me wonder if its worth selling anything there again.
