CHP Crashes Challenger and DUI

 An officer with the California Highway Patrol's Merced Area Office was arrested on suspicion of driving under the influence early Thursday, after a two-car collision on northbound Highway 99 near Livingston.

Fresno resident Joseph Mendoza, 26, was taken into custody after the crash, reported around 1:15 a.m. south of Cressey Way, according to Shane Ferriera, CHP spokesman.

Investigators say Mendoza rear-ended another car in the fast lane of the highway.

He was off-duty at the time of the crash and was driving a 2010 Dodge Challenger. Mendoza wasn't hurt in the crash, and the driver of the other car received minor injuries.

Before the crash, 29-year-old James Burns of Manteca was traveling in the fast lane of northbound Highway 99, driving a 2002 Volkswagen Jetta at an unknown rate of speed. Meanwhile, Mendoza was traveling behind Burns in the same lane, at an unknown rate of speed.



Mendoza crashed into the back of Burns' car, and both cars pulled over to the right shoulder. CHP officers arrived at the scene, and Mendoza was given a field sobriety test. Ferriera said Mendoza also submitted to a breath test, and officers determined he was driving with a blood alcohol level above the state's .08% legal limit.

Burns, who had minor injuries, declined an ambulance. As a precaution, he was taken to Mercy Medical Center Merced by the CHP. Both vehicles had moderate damage.

Mendoza was booked at the Merced County Jail on suspicion of misdemeanor driving under the influence and driving with a blood alcohol level of 0.8 or greater. He was released Thursday on his own recognizance.

Mendoza remains employed with the CHP and hasn't been placed on administrative leave, Ferriera said.

Ferriera said the case remains under investigation, and the CHP has launched its own internal investigation into the incident.

sounds right,,a cop can afford a 2010 challenger  :money: and is raceing a jetta  :faint: and loseing  :faint: gets mad because the other guy wont let him pass and rearends him at an unknown speed  :roflsmiley: and can get a dui and and gets released on the same day  :drunk: and keep his job   :poopoke:

Ya your normal resident of calif gets the drivers license jerked for 6 months to a year for a dui, especially when there's a crash involved. I guess this doesn't apply when your in law enforcement

 :wow: you guys are ANGRY. Lets just remember he is no Timothy Geithner, We dont know if he his license was suspended or not, if this was just any other regular guy this wouldnt even make the news, and he wasnt racing and if he was he must have caught the guy to rear end him....thats all I am saying :bigsmile:

Yeah, cops are people too.  There are good ones and bad ones, just like every other profession.  At least they arrested him right then. Now lets allow the investigation and the courts to do their thing and see what happens. This isn't over, it's just beginning. He could very well lose his license and his job, it just hasn't happened yet. As far as I know, most jobs don't fire you for misdemeanor traffic violations. Time will tell......    :drunk:     :bigsmile:

I wonder how many people this guy has arrested in the past & in the future IF he keeps his job. :villagers: That is why the other driver was taken by CHP to the hospital just to cover the CHPs backsides. I don't think they would have let the guy refuse a hospital visit, as they are preparing for a lawsuit no doubt. I am sure the drunk driver had his badge, ID & Gun with him because they are ON DUTY even when off duty. this cop should resign PERIOD, because he is to be held at a higher standard than civilians :2cents:

I don't know how it is handled in the rest of the country, but I do know here (Illinois) when an officer or fireman is involved in an situation like this, or other misconduct, they put them on "paid administrative leave" until there can be a hearing to seek termination.
There was recently a case in Chicago where an off duty Chicago cop who beat the cr*p out of a female bartender in a bar after she cut him off for being too drunk, caught on security cameras, was fired after the review board approved it.  It took something like 2 years for him to get fired, so I can only assume he was getting full pay and benefits during that time.  :stomp:
In another case recently in our newspapers here, a Chicago fireman who got convicted of multiple arsons and terminated, applied for his pension after he got out of jail.  The pension board fought his attempt to get the pension, but the judge ruled that since he wasn't on duty when he committed the arsons, they couldn't deny his pension.  :villagers:
Just a couple nights back, an off duty Chicago suburban cop lost control while driving approximately 80 mph on the highway, jumped the median, and hit an oncoming car head on.  That car's driver, a young man coming home from a second job, was killed instantly.  The officer's BAC was nearly 3x the legal limit.  At least he wasn't driving a Challenger.
What a country....

On Halloween, a police officer was shot and killed as he sat in his cruiser teaching a recruit.  In November 4 officers were assasinated while they had coffee before their shift.  A week ago 2 police officers were shot, one killed while responding to a domestic.  A month ago 2 officers responded to a home invasion where the suspect used the 911 caller as a shield and shot both the officers, shattering both lower leg bones for the one and striking the other officer in the shoulder and chest. 

Last year a police officer cleared a street corner of 14 year old drug dealers, walking the one home to his mother.  As the officers walked back to their cruisers, the 14 year old went up to his bedroom, pulled a .22 rifle from under his bed, opened the bedroom window, and shot one of the officers in the back of the head.  The 14 year old immediately texted his friend and said he was aiming for the other officer.  He got sentenced last month.....3-10 years.  The officer lived but will be dealing with that his whole life.

My point is...no one posts that stuff on message boards, but love to post when a cop does something wrong.   It is a sad day, to me, when people get so worked up over a cop doing something bad, but dont make any mention when an everyday person does the same.  He should be punished as anyone else, period.  and yes, I am a police officer.

My son is a Deputy Sherriff in Louisiana, very young. I worry about him everyday I am awake
