In Riverside California it's okay for the County to NOT HIRE you for a job if you smoke. Not smoking on duty or in an unsigned location, but if you smoke at home for your own pleasure you can be fired from your job or not hired at all. It started with the Police Department and I remember a lawsuit filed from a Street Repair employee but can't find the outcome.

This has nothing to do with second hand smoke, it basically says if you don't submit to the PC Health policies your job can be at risk. So the question needs to be asked, since obesity is the number one health cost isn't it only reasonable to assume that by hiring only thin people the State of California could potentially save billions in healthcare?

Anyone here ready for that rollercoster?

Smoking sucks indeed,  I also think fatty foods are unhelathy, also here is a list of other unhaelthy things we should ban:

Alcohol
fossil fuel burinig cars (how unhealthy are these?)
obesity (put all the fat people in jail until they are at a healthier weight)
caffienated beverages
sugar
chocolate
unprotected or premarital sex
coal burinig electrical plants
lifting with your back (use your legs or you will get a ticket)
sick people (if you have a cold and are seen in public you can get a ticket)
eating within an hour of swimming
not wearing a hat when it's cold
hunting
music I can convince others might lead to unhealhy lifestyles
dogs that may bite
eating foods past their expriation date
lack of exercise (two hours of exercise should be federally mandated each day)
I won't even begin with a ban on baby killing (because we should be able to kill them as long as they can't make noise)
etc.....
OK this is an old subject,  :horse: but Freedom to choose your own constructive or destructive behavior is something we take for granted.  Every time we take someone elses rights away, we lose a little of our own rights.
Ask when you enter a restaurant, ASK if they serve food with fat, or if smoking is allowed.  If you don't like the answer, take your money to a better restaurant.

I have to throw in helmet laws too. They absolutely suck. Yes I wear them when riding my sportbike and dirtbikes, but sometimes I just like to ride on my cruiser without one. I just take it easy. Now that I'm back in a helmet law state, I don't have the option. I also don't have the option to pick up chicks on it when I don't bring a spare. I Hawaii, I'd just give her the helmet, and off we go. In New York, I have to ride all the way home, pick up the helmet, ride all the way back and, what do you mean she left already?

No one has proven a link exists between second hand smoke and lung cancer (and no, I'm not a smoker and necer hace been).  Not even the World Health Organization (no right-wing group, they) after studying it for 12 years.  See here:

I don't care if you smoke and I'm not going to tell you not to.  If it bothers me, I'll go elsewhere.  That's the way it should be.  But somehow, non-smoker zealots feels they have the right to tell others what to do.  If the restaurant you patronize allows smoking and it bothers you, tell them you won't be dining there anymore and tell them why.  The owner of the business will then exercise his right to decide what legal activity he will allow in his business and what he won't.

And if smoking is that bad for you, ban it all together.  How hypocritical is it for any federal/state/local government to tell people that they will collect a tax when you purchase a product, but restrict its use because its deemed dangerous?  Ban it or leave it alone!

And name me another business that has to instruct people on how to stop using its product!

That's the catch though, they can't completely ban smoking altogether....they rake in tonnes of dosh annually from Smokers. I guess it just comes down to "be seen to be doing the right thing" ? No? I wish we had more non-smokers like you Mike, good attitude.  :icon16: All I'd like is some smokers pubs so we can enjoy beers and smokes until our hearts content without going out into the rain like dogs.  :villagers:

The Sherriff's department should be able to employ anyone they want.  And to set employment standards as they see fit.  If they feel a smoker may not be able to perform his or her job as well as a non smoker (physical tasks such as chasing down a criminal, or longevity issues such as not having a heart attack that puts them out of work)  they can employ the best person for the job.
The employee can CHOOSE if they want to smoke and find employment elsewhere, or not smoke and work for the sherriff's dept.

Likewise the restaurant owners and other business owners can CHOOSE if they want to employ smokers or allow their customers to smoke.  The employees and customers can then CHOOSEwhere to make or spend their money.
If people actually leave and stop spending money when they see smoking allowed in a restaurant (not just complain) there will be more and more restaurants and bars with voluntary "no smoking" signs on their doors, and no silly laws will be needed.

Laws are for LAZY people

So...if they don't want to employ blacks, is that OK under the definition listed above?  If not, then we need to know where the lines get drawn.  Banning emplyees that smoke is wrong.  It's a legal activity.  Why not ban people that drive to work, because driving is dangerous.  And I find it hilarious that a sheriff elected to enforce laws and rights is suddenly not concerned about the rights of people he doesn't like.  This is someone who doesn't understand the oath he took when he took the job.

BTW around here there is no smoking for many Fire Depts it was part of their collective bargaining agreement,  It gives them reduced insurance premiums.  Of course the old timers are exempt!

Left to the bar/restaurant owners very few will be smoke free as it hurts them money wise.There are also the employees that have to work there and breath the smoke.My wife was in a smoke free restaurant in Mass but was transfered,not volantarily,to a NH store that allows smoking.She is an ex-smoker but now has to breath it at work.As far as the government getting involved there are thousands of substances that are banned,controlled or regulated and have been for a lot of years.I am all for our freedoms but how many would be ok with having crack legalized?What do you think that would do to our crime rates?Smokers are free to kill themselves but I have seen too many people die from smoking and don`t want be one of them and most smokers I know care very liitle if they blow smoke in my face.

1.  The owner of the establishment decides if smoking is allowed.
2.  The patron of the establishment decides if they want to go there.
 
Did I miss anyone ?
 
I don't see the problem.  No one is forced to ban smoking in a business that they own, and no one is forced to go somewhere that allows smoking.
