Hi gang,

As most of you know I have a 71 cuda that is being restored over the last year. I received the finished shell back in July to reinstall the motor and drivetrain and had paid them almost $13K up to that point. Their original verbal estimate was about $13.5K done and painted. Paint was quoted at $3500.

Last month it went back to the body shop for what I thought was final paint. At that time I asked how much more I would owe them and the reply was $3500. Well that following week they asked for $3000 for additional bodywork on the fenders, hood and trunk. I agreed that it was necessary and paid them. One week after that was a request for $3000 check towards the final paint with a small balance to follow.

Saturday I go down to see my car and it almost done being painted and one of the owners says lets go over your bill. I am figuring the balance will be about $500 as I expected.

Drumroll please...........$10,124

No one ever told me that I was going to billed for 200 hours of block sanding, priming and sanding and plastic work.  I flipped out and told them that I did not have that kind of money. Their reply was...we will have to hold on to the car until you can resolve this..

The shop came highly recommended and we have become friends of sorts over the past year but wow...call me stupid. :dupe

Any clues as to what I should do now?  besides contact my lawyer.

I am uncertain but what is the total you have paid them so far? I suppose the 10k is above and beyond that? That hella sucks, I am not certain of anything else you can do besides contact your lawyer. Unless you okayed an opentab for them, they should have contacted you to let you know about cost overages. You should have some legal rights in this matter, but a lawyer will know a lot more than I do. Sorry to here about your situation hope it works out.

OUCH!!!!  I guess my only resolution would be that you should have had the estimate in writting, not only verbally.  I don't really know what you can do besides getting your lawyer involved because I've always had estimates written out for me prior to the work.  That way if the shop feels more work is needed, they need to contact you first and confirm that you want to spend the extra money above your estimate.  Hope this all works out for you and I'm curious what the other members have to say about this.

Just to clarify things a bit...the original estimate was for about $13,500 with paint. To date I have paid them $13,000 and figured I only had a balance of $500 when I picked up the car next week. The additional $10K would bring the total to somewhere near $24K.  Way more than I ever intended to spend.  Everytime they did something I asked how much it would cost.  I am on a tight budget and they knew that.

Another customer had commented last week in front of the owners that my car should be worth around $70K when completed.  I am wondering if they just decided to see if they could grab and extra piece of the pie.

It is possible that they heard what the value of the will be and they are trying to get more of the pie, but that is total BS. They are trying to double the price, I don't think so, call your lawyer ASAP.

Laura,

Nothing specific in writing other than the original paperwork that we both signed saying that it was a 71 cuda and it was in for restoration.  No amounts were specified just verbally.  My bad...

Everything has been done with a handshake and a smile to date.  I guess people aren't as honorable as a handshake used to be.

I would tell them to stop working on the car and contact your lawyer.  Sad situation.   :villagers:

At this point you must tell them to cease work. After that you are to get a detailed list of work performed, labor costs and parts. This should be as detailed as you can get them to give you. Then I would hope that you paid by check or received a receipt for any monies paid to date. Take all of this to Dewey, Screwem and Howe. There has to be some extraordinary charges in there that they will not be able to justify. You may want to take the list to a couple of other credible restoration shops and show them the list (w/o dollar figures) as if it were a list of work that they will be performing for you. A good lawyer will pick those charges apart and if proven to be above and beyond market values you will be fine. You will need to take this to court. Alot of times once your lawyer contacts them they will drop everything.

That is a stunningly significant difference.


Verbal is still somewhat binding but not as concrete/slamdunk as "written".

I did tell him to stop last night and he said he had to finish and we would work it out later.  Today I get a call from his partner offering to take 50 hours off the bill. A miserly $2500.  

I just read through the thread about 71Fishes brother....my God it is so similar it is scary...

Tomorrow my first call is to a lawyer....stayed tuned, I am sure this is far from over.

I don't know about your state but here in California a shop CAN NOT exceed the original estimate by more than 10% or we have a state organization called the bureau of automotive repair that handles the complaints!!
I have heard of things like this happening before... they could be trying to be putting a mechanics lein on your car and keeping it for themselves because it is gonna be so valuable!! and boy does that SUCK!!  I agree about taking them to court!! and definately STOP THEM FROM DOING ANY MORE WORK ON YOUR CAR!!!!! Maybe go down there and take pictures of it too! so in case they try and sabotage it or something you have proof of what it looks like NOW!! cover your butt!  Good luck! wow this sure sucks!!
