Title Problem: I am getting concerned
« on: November 15, 2006 - 09:26:19 AM »
I recently bought my car (71 Chally convt) off a guy who did not have the title in hand.  He was getting a replacement from his state, Mass, but they are giving him the runaround.  I now have the car in my possession in Missouri.  How bad did I screw this up?  Would going through Broadway Title be the best route?

Ironically, had the same thing happened to me when I bought a 71 Challenger convertable from the original owner.   I ended up using   http://www.its-titles.com/    they were less expensive than Broadway.

You should be okay if you have a bill of sale. If you don't at least have that, the guy could claim it was stolen. I don't think you can go through a title company if there has been activity within a certain number of years. I would talk to the DMV in both Mass, and MI to see what can be done. In PA here, they won't let you do anything.

I would check into getting a title from a title company. If you have a bill of sale you should be able to get a title with little problems.

It really depends on your State. I had a title, but got crap for not having a notarized bill of sale. Don't I love living in Maryland?   :dupe:

If you get a title from a title company, make sure you have a paper trail.  Get as much prior paperwork on the car as you can get.  That way in the future if the title is challenged you have proof the car should be yours.  Try to give copies of the original bills of sale, etc., whenever you can.  The originals always hold up the best legally in the future.

I bought a convertible b body from Mass. 4 years ago and only got a bill of sale which California had no problem with.  Mass does not title cars made prior to (I think)1984 and a Bill of Sale signed by the registered owner is all thats required.  California had me take the car to the local CHP office where an officer trained to look for proper body VIN stamps etc looked over the car and signed off that the car was VINed as listed in the Bill of Sale and he then did a stolen car check which came back clean.  Took an extra hour for me but thats all.  Maybe your state DMV will do the same?

In Mass now every car is required to have a title. If the owner of the car purchased it before title where madatory or came in from out of state where a title is not required, you can register the car with a bill of sale and a registraion proofing the seller had paid taxes on it (it's all about the taxes). If the car had a title you need the title in this state. The previous owner can file for a duplicate title for $25.00 and it only takes a week or so to get it. I have the forms for duplicate titles if you need one.
