Well there is only one person at fault and thats me, I should have visually checked the numbers on the block. Though why on earth does Mother Mopar hide them under the car. Somebody mentioned that its possible he didn't know and somebody told him it was a 340. Which is possible. He represented it as a 340 to me and to my bank's agents since it was a long distance purchase (I am in Austin he is in Ardmore, Oklahoma). I went to see the car, looked it over pointed out some problems that were visible. Leaking gas under the carb (easy fix), rust in the lower kick ups, carpet was new, but not the correct 2 piece, none of the gauges worked but otherwise the car was solid, hence my offer of 2k below asking. Car was solid, complete interior and was in great driver condition. The carb is pretty large for a 318.
