Some feedback/advice, please

I need to get some other views on an issue and make sure I'm not missing something before I make a decision.

Years ago (like decades ago) I used to freelance for some magazines, whatever interested me and I had something to write about: cars, photography, computers, models, etc. It never turned into a lot but I made a little extra from it. When I got laid off I decided to try to get back into that and see if I could make some money at it today. I had already inquired at a Mopar magazine (which, for the moment, shall remain nameless) before the job ended. I had pitched a number of article ideas, and ended by telling the editor that I lived with half an hour or so of Rockingham and could cover Mopars at the Rock. He wrote back to tell me that none of my articles interested him, but that I could consider Mopars at the Rock "an assignment." We exchanged a couple of other e-mails, so he was aware that I received the "assignment" e-mail.

Flash forward. I covered the Rock show, such as it was. I arrived just after the gates opened, interviewed some car owners, interviewed some vendors, and was just getting ready to covere the just-beginning drags when the skies opened up, at which point I talked to Dave and his buddy for a while before people decided to bail out. I arranged to get the show car winner names and the drag results. In other words, a fair amount of work, albeit enjoyable work.

One other thing here; several people told me that someone else was going around the show claiming to be covering for the same mag. Didn't meet up with the guy and don't know if this is true, but at least three different people told me this.

After the show I e-mailed the editor and asked how he wanted to receive art, and told him I'd have a completed piece to him by the end of the week. I never heard from him. I gave him a few days and sent a reminder note, but still never heard from him.

Frankly, even though it was an "assignment," I think I'm screwed for getting paid for anything I did. This is partially my fault. I should have immediately e-mailed him back after the assignment e-mail and asked for payment rates and other details; without that, he's free to say that the assignment was to cover the show but that we never had a contract for payment or publication. I had assumed that I could take him at his word, and in a similar situation to those posted by some others recently, I found out that his word isn't worth much.

What I'm really wondering is, should I out him for his bad business practices? Should I warn people to be wary in dealings with him, his publication, and the other pubs under the same group? On the one hand, this almost certainly guarantees that I'll never get another "assignment" from him, but given how this one went I don't think I care about that. What I'm more concerned about is, how will other editors perceive this, and will it keep me from getting work published elsewhere?

that really stinks...  I guess I would try to get another big magazine to use your article ( payed for or not...) and let the guy`s boss know by letter what happened and what his mag missed....throw in a copy of whoever uses the material.

If you didn't discuss any rates or anything, you pretty much did it for free and/or like a test or your resume'.  I would consider it a learning lesson and then move on from there.  Try to keep a positive attitude always helps.

I think you may be out of luck on this one.

I was helping our marketing department at work when they downsized by writing some articles for trade publications on my off hours, we had a verbal agreement for $50 per article, well when they decided they didn't want me helping out anymore after 11 months of this, they tried to stiff me for about 15 submitted articles. Had to get the VP of the department I work in involved for them to pay me. If I were to work for marketing again, I'd get the agreement in writing.
 
I would use it as a positive thing on your resume "I've worked with x magazine to document Mopars at the Rock"
And I also agree that a written letter would be appropriate while a public statement may turn around and bite you. There aren't a lot of Mopar publications out there to choose from and I wouldn't be surprised if there was some communication between the various publications on a social level.

 :iagree:  It stinks, but I'd say it's not worth staying angry about it.  Since he's not bothered to return your e-mails or calls, I think you're free to see about getting published in one of the other mags.  If he sees it later and makes a legal stink, you can keep the copies of e-mails you sent to him as evidence that you attempted to contact him after the fact.  One of the things I've learned in business is to request read receipts on e-mails where you want to know if the receiver has read it.  They don't always come back, but at least you have a chance of proving that you attempted to make contact.  Live and learn and avoid the guy next time.

Well, that's pretty much the conclusion I had come to as well. Now what I like, but what can you do  :dunno: Thanks for the comments, guys.

Much as I would love to believe that this would help, I doubt the boss would care. The publishing industry is, in its way, as low and sleazy as Hollywood, and the pay is awful. I've actually had two offers in the past to run magazines or significant portions thereof; I turned them both down because I could make more with a seriously dedicated paper route. One of the offers was at Autoweek, where I blew them away in the interview by virtue of knowing what a ceramic valve was  :roflsmiley:

If I don't miss my guess, their mag won't miss anything. I think he forgot about me, sent somebody else to cover the show, and when I got in contact with him afterward he figured he didn't owe me anything. And in a sense he's right. Aside from the value of his word (apparently less than nothing) there's nothing forcing his to use my work.

Chances are he could just be out of the office on his "assignment".

Or he could be blowing you off. Hard to say. Odds are he could have also had someone else at the event  doing the same freelance job.

An aquaintance of mine occasionally does this.  He submits articles and sometimes they get used, sometimes they don't. He does get published occasionally and everything he does is on his dime. So when he writes up a cam comparison, it is because he is wanting to choose a cam for one of his vehicles and he is buying a half dozen cams, and is paying for the dyno time to test as well as writing the article and organizing pictures. So he could concievably spend three to four thousand dollars putting together an article that will make him around $1000, if it gets used.

Still a hit or miss proposition as a free lancer.

I don't know that I would read anything into his actions. Put it all together in a nice format, submit it to some other mags. There are still several mopar specific reads out there.

...recently, I had a conversation with a MOPAR magazine editor.....he was interested in an article/pix of a car I own, plus a few others in my town(one owner survivors)....he told me to call him before I emailed him so he would look for the email....says he gets too many to read....maybe the same magazine, maybe it just got lost in the shuffle...sux anyway

Hey David.  I know this is a dissapointment for you....and me.   However, you have the pics, the information and the foritude to go forward.   I would send one more email with the reply receipt and if no responce, go to another magazine.   You did put in a lot of work and you deserve to get some credit for it.   Good luck.   Dave

Agreed to a point. When I have freelanced, I've always freelanced on my dime. To me (as a writer, editor, English major) there's a difference between freelancing and an "assignment." The latter implies that I'm expected to send something in, and by extension, he's expected to respond  :dunno:

I'm going to work on some of my other pitches and send them to other mags. And frankly, as much as I love Mopars, there's no reason I need to limit my articles to Mopar mags.

That's entirely possible, but he did read and respond to 5 e-mails.

Belive me, I understand that. I've had stories run without payment, stories run without attribution, and stories attributed to other writers.

For the record, BTW, the Autoweek editorial staff were great. The HR people, who made me the job offer, were a55es.
