There was something similar a few months back. A woman thought she was buying an I-phone, when indeed, all she received was a picture of one.     She took the case to some court on TV, and the judge laughed the seller out of the courtroom. I hope the same happends here.

Hey, the auction says "BOX AND INSTRUCTIONS" - nothing about a phone.  It's very sad that A) people can be that stupid and gullible and B) that other people look to capitalize on all the stupid people out there.  Then again, if survival of the fittest works for the animal kingdom it might as well apply to mankind as well.

Personally, it's a phone... They couldnt' sell enough of the original iPhone - why the hell is the new one so special?

  i could not beleive some people would not read more carefully, unless the posting was edited just before final sale ending time.   The editing on a listed item is very easy to do if you are the seller, hope he has not changed it at the last second to suck people in.

Yeah but Ebay policies protect buyers if auctions are changed after bids are placed.  The buyer can retract bids if the seller changes the description.

The buyer could have gone down to an AT&T store and bought a new box and set of instructions for $199 and it would have come with a new 3G iPhone that she could have given to me!
