There was nothing to sign. All I had to do was take the customs papers to the customs office , pay some money then give that back to the bond shed and take the car. The lady at the bond shed said that I would have to contact the shipper not them?

I think what I would have done is call local law enforcement, have them write it up as an accident before I claimed the car. At least it would have been a very big hurdle for the shipping company to jump. Hard to sidestep documentation like that.

chiming in at the 12th hour


 DAS for the most part sublets out their deliveries. sometimes and ver rarely do they use DAS trucks. So here is how I would look at it. It really is no big deal to bring action in court, most law firms will assist with the paperwork

Sue the seller
Sue whoever agreed to pickup the car
Sue whoever delivered the car
And sue the bond company for not noting any damage


they will all have to answer or default. If they default you have a winning judgement against them and now you have to collect, if they choose to defend it, all of them you will have a case to present to a attorney to see what your recourse is and how much it will cost to get some money. You will find in most cases it will not make $$ to continue and you can drop the suit. You will find some will offer to settle to get out of
the suit. But if you think you can call the cops or file a claim and everyon is going to jump up and down to help, you are mistaken. Those days are long gone. It is every man for himself and sometimes it takes a lawsuit to get their attention. Threaten a lawsuit does nothing. Do you know how many people threaten a suit and never go forward? So the its a numbers game. You need to go forward, at least with the next step or live with it   :chatting:

Why sue the seller? I dont see where that person would have anything to answer for.  :clueless:  I dont see where he/she would be liable. If I sold a car and someone sued me for damages that happened during shipment while another seperate entity had legal control of the vehicle I would countersue their ass for harassment.

If you go around suing everyone and their brother, the case will likely be thrown out as a frivolous suit.  Besides, you need the seller to help you on this, to provide all the details of the condition when it was picked up.  Why piss him off by dragging him into court?  The only one you can go after on this is DAS, because they held the contract.

No I wouldn't think of suing the seller. He was really pissed off that it happened. He said if he could help in any way to let him know. He's on my side!

I read it wrong, I that you had some issues with the seller also.

 No it will not be friverlous lawsuit, if you do not know who the responsibile party is, you bring everyone to the carpet. Trust me being a X business owner who has been on both sides, I have spent a few bucks with lawfirms straighting out things I wasn;t even involve in. It is part of the process and unfortuately because companies do not fess up when they make a mistake, this is the best recourse.

This is almost funny! DAS is offering me $400 for the front valance ( the estimate was $650 from a Chrysler body shop) they say I have to pay a $250 deductible?? So let me get this straight I'm thinking..... THEY damage my car and I have to pay part of the repair bill????? :screwy:
But on the bright side they seem to be accepting responsibility for some of the damage! The tranny estimate was $1400 but they say they are not covering that at this time????? ::)

You should have them pretty well.  If they are admiting partial fault, then you should be able to nail them for everything.
