Ebay deal gone bad , maybe??

Hi guys
 I bought this 1970 Challenger off e-bay     1970  Dodge : Challenger Item number: 320309150095   The seller has always seemed honest and always answered all my e-mails . He said he bought a lot of cars in an estate sale my challenger being one of them.  After the auction I find out that the title is not in his name. I'm in Canada . I tell him that I'm assuming the title and the bill of sale name need to match of it will be a problem at the border. He understood and said he will get it changed. That was a month ago. After checking a couple of times a week via e-mail He says still nothing from DMV in California. So I find a 1-800 # on the net and call myself. I'm told it takes 5 -8 weeks???? Takes about 1 minute here in Canada??? So I ask her to run the vin# to see how things are progressing? She tells me that there is no vin#  in the system!!! So now I'm starting to panic! Have I got scamed? So I e-mail the seller and tell him ! I get a reply a couple days later saying he is out of town on a family emergency and he will look into it when he gets back today ( this friday). I don't want to piss him off or insult him but with 1 day to go on e-bays VPP do I start that?
I e-mailed e-bay and explained the situation and they said I could go the e-bay VPP route but only for 1 day!
What do I do? I really want the car but obviously don't want to get scamed either!

I'd not take chance & make the claim w/ebay.....If he's legit & any kind of reasonable person it should not be a problem.

I agree, don't wait.  It's a buyer's market.  If he's legit it won't be a problem.

 :iagree: protect yourself. I believe you can always drop those as resolved or cancel them. As mentioned, if he's legit he won't care. Just send him a heads up note so he knows you're doing it and explain why. He should completely understand.

I agree with everyone here, start the claim while you still can. Does not sound good to me. Good luck and keep us posted as to what happens. Maybe someone lives near the guy and if all else fails can check him out a little more thouroughly.

I just filed with E-bays VPP  so I'll keep you posted. My gut tells me this is not a scam but I can't take the chance!  Either the lady at the California DMV has made an error or I have gotten the wrong Vin # or something " funky" is going on. :drama:

If the previous owner owed any back child support, he may have a difficult time getting the car's title transferred. Other wise it shouldn't be a problem. If the title is signed and notarized by the title holder, that should be good enough. He can probably make up a Bill of Sale on his computer. If you have questions,PM me. As I have dealt with these types of issues in the past. Shipping a car to Canada can be a real pain. I would sooner ship one to Europe. There are a few members that may live closer to you that could help you out. Good Luck!! BTW  :useless:

if the car is not registered in Calif, they would have no record of it and assumming since he said it was not in his name, he probably did what alot of Californians do to avoid sales tax for as long as can and not transfer the title. Also Calif records dont go back that far, so it would have to be currently registered. I would file the claim, as if you think you are not getting paid and let him address it, he will have no problem if it is legit. Can I ask did you pay in full or you looking for the $1,000 deposit back? Paypal is tricky on deposits. Good luck keep us posted  :popcorn:

There could be many things affecting the title, and those things vary from state to state. For example, here in PA, the steps would be as follows...

1. Current title would have to be located (not as easy as it sounds sometimes. Titles get thrown away, misplaced, etc).
2. Death certificate of owner would have to be provided to DMV, and title would have to be transferred to next appropriate next of kin (Again, many possible "ifs")
3. New title would have to be received by next of kin.
4. New owner (next of kin) would have to sign over title to purchaser (ebay seller).
5. Title would have to be received by purchaser (ebay seller).
6. Purchaser would sign title over to new purchaser (you).

Depending on how it was done, each step could take several weeks. And here's another wrinkle: Suppose the guy that died did not have a title in his name? You would have to try and track down the last "real" owner of the vehicle (might be impossible), or just sidestep the laws and use a title company to get a new title.

Tip: When buying a car on ebay, or any other website, ask if the seller has a clear title in his/her name. If not, you should probably stay away from the vehicle, unless that state does not issue titles to older vehicles. In that case, you need to get, at the very least, a notarized bill of sale that includes positive identification of the seller. Sounds like that may not be enough for Canadas laws, though.

I think you did the right thing by filing with ebay. You can always mark it resolved at a later date. Its his fault for not having the proper paperwork in the first place. Something may be a little fishy, because if it were a legitimate estate sale, all proper paperwork would have been provided to him. Of course, the term "estate sale" can mean a lot of things, including the survivor just putting the cars out in the yard with a for sale sign on them.

Yep that's it! I do have lots of other pictures that he sent to me. I was just wanting a clean rust free as possible rolling shell. The 440 was a bonus in my opinion? My inlaws live in PA so I'm going to get a quote to ship it either there or to Toronto ( 60 miles south of me) It might be easier/cheaper to bring it across myself, this will be my 4th time doing that.
