Harassed again!!!
« on: April 26, 2009 - 10:50:20 PM »
For the second time in two years I have yet been pulled over again by an officer that does not know the law about running vintage tags. Both times I have recited the general statute that clearly states that I can legally run them and both times the officer argues with me telling me to remove it. The big kicker is that both times have been in the same small town that is known for pulling people for stupid reasons. This time my wife and I were out for a pleasant cruise to get dinner and the police had me pulled for over 30 minutes just to come back and give me a "warning" and to remove the plate. Tommorrow I'm going to fax the general statute to the chief of police and give him a piece of my mind about wasting my time due to his departments lack of knowledge of the law. Just for anyone else in the state of NC here is the statute that covers the use of vintage tags:   :villagers:

One of the little known facts about displaying a license plate in North Carolina is that if your vehicle is old enough, you can display the tag that was issued the year the vehicle was made instead of the one assigned to the current vehicle registration.  In general, you have to have the current tag available to show to somebody when they ask for it (put the tag in the glovebox, trunk, or under the seat), your vehicle has to be at least thirty-five years old, and the tag that you use has to have the year stamped into the metal and this year has to be the same as the year the vehicle was manufactured.

The complete text of G.S. 20-63(d) reads:

"Registration plates issued for a motor vehicle other than a motorcycle, trailer, or semitrailer shall be attached thereto, one in the front and the other in the rear: Provided, that when only one registration plate is issued for a motor vehicle other than a truck-tractor, said registration plate shall be attached to the rear of the motor vehicle. The registration plate issued for a truck-tractor shall be attached to the front thereof. Provided further, that when only one registration plate is issued for a motor vehicle and this motor vehicle is transporting a substance that may adhere to the plate so as to cover or discolor the plate or if the motor vehicle has a mechanical loading device that may damage the plate, the registration plate may be attached to the front of the motor vehicle.

Any motor vehicle of the age of 35 years or more from the date of manufacture may bear the license plates of the year of manufacture instead of the current registration plates, if the current registration plates are maintained within the vehicle and produced upon the request of any person.

The Division shall provide registered owners of motorcycles and motorcycle trailers with suitably reduced size registration plates."

It is a good idea to keep a copy of this paragraph of the general stature handy in your vehicle along with the tag of current registration just in case somebody isn't up to date and tries to give you a hard time about the one that you have bolted onto the vehicle.   Having the year of manufacture tag not only can help provide the correct "look" for an antique, it can serve as a subtle way to answer that question of "what year is it?".

What a pain in the butt, sorry for your troubles.  :(

My neighbor is having some construction work done on his house and the guy who runs the company won't even take any jobs in the next town over because there's one policeman that intentionally harasses commercial vehicles.  He keeps giving them tickets and pulling them over for no apparent reason since they are commercial vehicles.  This in no way is a reflection on the rest of the police officers in that town.  Just this particular officer is pretty tough on commercial vehicles.

When I go to the local DMV I sometimes bring the regulation with me. Printed on paper from there own website.  Especially when I am bonding a title or buying a vehicle from the abandon vehicle auction.

You could do the same and fold it up in your glovebox.

He would probably give you a hard time anyway though.

I haven`t had any trouble with law enforcement but have had to argue with mechanics when I go to get my cuda inspected. All vehicles with antique paltes get inspected in April instead of the month of your birthday which is when you renew your registration.I also keep a copy of the inspection law in my glove box to show the mechanic.Frustrating when you need to tell someone how to do their job correctly-ecspecially a LEO with an attitude!

I will for sure keep a copy of the law in the car from now on. What frustrates me is that I told him the statute # right off the bat and when he came back to the car he acted like he didnt even look it up! I didnt think of it at the time but I just had the car inspected by the state highway patrol a week earlier for title reasons and I asked the trooper if he wanted to see the actual tag since I had the vintage one on the car and he told me not to worry about it!!! The NC highway patrol is the highest ranking authority in the state and didnt bat an eye at the plate!!! I wouldnt been so mad if he didnt have me pulled over for so long ruining our evening not to mention the fact that it embarrassing as well!!

I think what happened is that he had a rookie with him and couldnt admit he was wrong. At one point he looked as if he was pulling out the "real" ticket book as the other officer was on the phone. My thought is that he was going to ticket me for the plate but couldnt be sure he was in the right. I just called the town police and talked to the cheif of police who was appollogetic and confirms that I"m totally in the right and that he is going to send out a memo to make sure this doesnt happen again!! Nice guy.

I am a little north of you (still in the south) in Virginia. I've had similar problems with antique tags and getting pulled. Antique tags in VA are permanent and require no state inspection sticker which is required on all other vehicles. Cops see my car and no inspection sticker on the windshield and it's time for lights and siren!! I always keep a copy of the state antique tag regulations in the car for an education lesson. Usually the cops are friendly and polite, just uneducated. It is a hassle and it often ends up with me opening the hood and having a motor head discussion before I leave. I usually find it humorous with the exception of the few butt-head cops or if I am in a hurry. :roflsmiley:
