So the legal battle begins for custody....
« on: April 29, 2010 - 07:21:13 PM »
Today my nephew's dad was served a subpoena for the initial hearing in our case to get custody of my nephew. For those of you who don't know, or don't remember, we got Nathan (my nephew) in October because his dad had the police called on him for punching him in the face in his front yard. Nathan is 5 years old. His father is a drug-addict criminal low life. We used our tax return to pay the lawyer so we can go to court.

So anyway, today was the start of the battle. His dad was served this morning, and obviously wasn't very happy about it. We will have an initial hearing, then if the judge decides it's necessary we will go to a final hearing a few weeks later. I just hope the fees don't run more than the retainer that we have paid.

Best of luck. My family had a similar case.  My younger sister was into drugs so my Uncle tried to get custody of one of her four kids (from three different men).  He lost becuase my older sister lied on the stand about our sisters character.  The girl in question was pregnant two years later at 14.

Such a sad situation. I wish the best for you and of course for the child. I also hope his dad can turn his life around and become the dad that every child needs!! Until then he needs a stable loving home. Sounds like you're just the ticket. Stepping up and taking him in speaks volumes of your character & compassion. You'll be in my prayers!!

I was thinking about that story just the other day, just couldn`t remember which member here came with it  :screwy:
I hope all turns out the way you hope it will, and the kid gets a fair chance to grow up in a good environment with all the love a kid needs.  How`s he doing at the moment?

Hope it goes well for you  :2thumbs: perhaps your local county Children Services office can assist as well, with the background you share they certainly are aware of the family history/situation. Good Luck   :2thumbs:

Thanks yall. We have a very strong case against him. He has 4 kids total and all four are in the process of being legally fought over. He has had multiple CPS cases against him over the past 2 years. He has been to jail on multiple occasions for multiple drug and theft charges. He says he only wants the child that we have, and not his other 3. IMO if you don't want one of your children you shouldn't be allowed to keep any of them. You don't pick and choose your children.

Thanks for the support yall. It can be pretty stressful, especially for my wife.

This is definitely a tough issue, but I think you're doing the right thing for the long run. Good luck.

Good for you.  I'm not joking when I say, if you need help drop me a line.  I'll see what I can do to help out.  If nothing else I'll attempt fundraisers to help you out.  No kidding let me know.

Bringing up children today is hard enough, but taking on somebody else's child especially in these situations is not easy. Too many forget about the child and the need to protect and raise them to be responsible adults. Children are the future, may GOD guide you and your family, I will also pray for this situation.   :angelwings:
