Hey fellows:
 I'm in a quandry as to what to do.
Back in early April I purchased a master cylinder and prop valve for my challenger (wont mention name of company), It was mailed to my home address but it never arrived. The company who shipped it sent it parcel via USPS uninsured. He did send me the tracking # and it made it to Dallas on 4/8. Thats where it still shows it to be. Numerous calls to poastal inspections, consumer affairs, etc. it seems it is lost for good. In talking to the company that sold it ,he said that he has always used parcel (uninsuerd) and has never had any issues with deliverly "this is the first time ever". I paid 75$ for each part and 31$ shipping fees.
He has offered to sell me another set at "his cost" which I don't know the cost (his cost) yet. I did not have the option as to how the parts were to be shipped and wether or not it would be insured. All I know is I'm out $180 and nothing to show for it.
I know the guy mailed it, so he actually held up his end of the deal except , it didn't make it to me.
Do you fellows see any fault by him or is it just "stuff happens" by the postal service?
Is he being fair to me to offer the replacement parts at his cost?
What would you do?

i would see if the shiping comp will replace it they lost it right

The shipping company is the United States Postal Service...... The said they are not responsible if it wasn't insured.

i would wait it out if you can i had them louse a part of mine a few years ago and i got it like 2 mounths late but i did get it,they probley just mised placed it and when they find it they will ship it to you.but if you cant wait you will have to pay again whith sucks but make him send it ups and have you sing for it

I thought the insurance was for damage to the package. If USPS shows it made it to their depot but never left then I would think they should have to find it or reimburse you for it. :2cents:
If I cant fix it, it's broke

He said they mailed it UNINSURED. They must have sent it delivery conformation. How do you know it was yours he shipped and not someone else's package that lives in Dallas?

 I thought anything shipped Priority Mail, the most common method, was insured for $100. automatically??   At least their competition does... USPS should at least refund their shipping charge & just who decides how to ship & insure or not insure? You or the vendor?
 If not you contact your credit card people & report the lack of fulfillment of your purchase.

Shatar, that was my point. I thought insurance was for damage, not lack of delivery.Why would you have to pay for delivery insurance if that is what they do. If they wouldn't cover it after admitting they had it in their possession, I would think they are at fault. Isn't that what computer tracking is all about?

First he shipped it and is responsible for it as you paid him. If you paid paypal or visa go after him.
Second, someone at the post office has to be responsilbe for that item.

If all avenues are exhausted, then the seller needs to man up and get the stuff to you again. There's a first time for anything. His excused doesn't set him free.

 Sorry to say I think your screwed too! I rarely use USPS. I ship parts daily but use other carriers. Yes a little more money, yes people whine at times.......................... but they get their stuff!  :grinyes:

I agree.  If it is the first time, then it should be the last time it happens.
This being said, he would only have to pay one customer for the problem and end up with a loyal customer out of it.   Man up.

Having been in the vendors position before, I simply refunded the money. Sucks, yeah, but sometimes that is the cost of doing business. You might ask him for that and then purchase elsewhere.

I know I'm up here in the sticks but please help me understand how this is the sellers fault. There is proof that they were in deed sent out. I don't understand how it's the sellers responsibility to guarantee the PO won't screw it up. If the article was not breakable I would have not insured it either. I would believe it's neither the buyer or sellers fault. The PO lost it not the seller. I would think the seller should do what they could to help resolve the problem but there is just no way any seller can guarantee the shipper won't screw up.  :2cents:
