12/3 - update. As of yesterday the attorney, who specializes in fraud cases, has drafted and faxed (also registered letter) to the Maaco owner. He advises that..
- the 1970 plymouth cuda be released to the owner immediately
- $9500 be redeemed to the owner of the cuda
- Document that owner was directed 3 times to stop work on said car immediately.. (2 weeks ago or day of invoice)
- he is being charged with 4 counts of consumer fraud.
- suing for 45k in damages (NJ ststes you can sue up to 3X money spent which is 3 x 15k my brother paid)

When I see a copy of this I can elaborate more. The gist is there's only ONE (1) quote.. for $5500. My brother paid an addition 9500 to cover any additional metal fabrication etc. The next quote.. is not a quote, but an invoice for 75k.. 8 months later. The attorney said he broke 4 laws by doing this. I have copies of the automotive fraud statutes. This guy is totally screwed. It states NO work can be done beyond the agreed quote w/o written consent or documented/signed revisement of the intitial quote. Unless it's after hours etc.. but is another situation.

This is my take on what this guy was trying to pull. He found how valuable the car is & thought if he goes high on price.. if he cuts 10-20 grand my brother would think  "jeepers tanks for such a grate deAl.."... or he knows the boundaries of the law and finally put together his exagerated invoice right before the car was to be finish painted. Knowing that my brother would be drooling to get the car back, he would say.. we can work with the #'s, but let me finish your car. By doing so, it could be argued that the consumer is "OK" with the price, but just working out the details. So what is favorable about this situation is..

- there's only one quote for $5500
- never agreed on a price over that amount.. nada, none zilch, no other documented quotes
- Owner was asked to stop work on the car IMMEDIATELY after receiving the 75k invoice

In NJ, all contracts need to be documented.. period. This guy tried to put a complete restification price tag on a valuable mopar.. what he forgot is the reason why proper restoration prices can get expensive is where you replace parts with new or NOS and shop reputaion.. he did none of that. Didn't toucfh the drivetrain, suspension, brakes.. no bead-blasting the under carriaqge.. guy is totally out to lunch. I'm gonna talk my brother into getting all of his other parts, i.e. new bumpers, 70 mirrors, raley hood etc..

What sucs is this guy can hold this up in court for up to 3 years he said, which is not6 a big deal as long as the car is in my brother's possesion.

Sounds like you are on the right track, it's a real pain in the butt to deal with creeps like this. Hope it all works out and the car gets returned soon without any (additional modifications) done by the jerk. This sounds a lot more promising for getting the car back, but don't count on seeing one penny from the shop owner. It would be great if your brother gets compensated for the money he spent, or even the additional amount, but getting the car back is the most important part. Hopefully, he can take possession & it won't stay at Maaco or a neutral party location where he can be charged storage.

When I filed that suit against the shop that jerked me around, it was the same deal. Three times the amount because of fraud & deception, & done in a civil court, not small claims. I spent roughly $3000 on crap body work, spent almost $1000 on building materials for work I was doing in his building, & countless hours of labor doing it. We did have a verbal deal to trade some services for the remainder of the work, but I did have written proof.

I won my case for the full amount of almost $13,000.00 & he never appeared in court. The guy also didn't have a penny in his name, & had roughly $250,000.00 in outstanding judgments against him. (Smart, I suppose.) All his assets were in his wife's name, a luxury condo, several expensive cars, & nothing that was ever recently shown to be transferred out of his name. I guess it's a perfect way to really cover your tracks.

One thing I would suggest is to double check that the particular Maaco franchise, shop, building, or whatever this business may be, is actually his, & in his name. Your lawyer will know how to research that. You could theoretically get as far as being before the judge, & suddenly the guy produces documentation showing he doesn't own the shop, or responsible for any billing decisions. This will drag out the process even longer starting from scratch. (This happened to a friend of mine.)

I feel so bad that your brother has to go through this at all.  It sounds like this creep will get what is coming to him.  I hope he gets all that he deserves.  It would be great if your brother gets "custody" of his cuda.  I would be sooooooooo worried about the car if it were in that jerks possession.  Thanks for keeping us updated with your brothers mess.  We will all learn from this and keep his story in the back of our minds next time we allow someone to touch our cars.

Well on the 11th hour before the first court date (which would've been today) the crooks lawyer must've advised that he would've lost his AZZ in court. the short of it is we pick the 70 vert up on Saturday. He relinquishes the cuda & all parts & will pay lawyer fees of 8 grand. My brother has to make no further payments.

I guess it didn't help that Maaco was also asigned in the to-be lawsuit & the guy charging 75k.. was not licensed to practice autobody in the state of NJ. He prob would've had his doors closed.

I know, I know.. petal to the metal & screw the guy.. but I'd just want my car back too. So now the car just needs to be painted... it's already block sanded etc.  We'll have to start the car & let it run for awhile to ensure nothing was tampered with etc.. Can't wait to see this A..Hole face to face on Saturday.   :mad: :boxer:
