Wow, what a mess.  Glad you and your son are okay.

I have Hagerty too and always wondered something.  If my car is worth $50K but I only have it insured for my parts and money that I have invested, $25K,  (none of my own labor) Would the other insurance company only give me what I have it insured for?  Don't they have to find me a comparable car being sold then give me that amount?   I don't see how Hagerty would subrogate $50K when my agreed value is only $25K. Hagerty shouldn't have to get involved unless you have a problem.

I've had daily drivers totaled by other drivers when I only had liability insurance. I always showed other cars listed for sale and we started haggling from that price.

I hope this all works out and can say any accidents I ever had have almost always worked out ok for me when someone else was at fault.

Well. I'm finding that Hagerty's isn't all that up for protecting my best interests, or so it seems.  My mistake apparently was not to raise the declared value of the car when we finished it.  It is/was insured for $30K and the damages (parts and labor) look to me to be about $21K.  On the face of it, that wouldn't seem like a problem, especially since the other guy (a trucking co.) was deemed 100% responsible and he has insurance, but Hagerty's figures it differently.  The adjuster put out the car for a salvage bid, and someone said they would give Hagerty $12.5K for it, so Hagerty subtracts the $12.5K from $30K and says that that they're not comfortable paying me more than $17.5K.  What they're saying is that if they "totaled" it, they would give me $30K and then sell the car for $12.5K so they would only be out $17.5K.  But wouldn't they subrogate that cost to the other insurance company?  Well, according to the adjuster, the other company would balk at paying that kind of money out on a 40 year old car.  So far, the Hagerty experience isn't exactly the warm and fuzzy one portrayed in their email and magazines.

We had a very nice (but far from perfect) '68 Camaro that was stolen in 2005 and it was insured with 21st Century as a daily driver.  I was pretty sure that we were going to get next to nothing for a settlement, but 21st Century totally surprised us.  Without any prompting, they enlisted a company in L.A. to assign a value to the car.  They used classified ads and determined "comps" for '68 Camaros, and 21st Century ended up paying us a very handsome settlement (over $20K) that was twice what I expected and a few thousand more than I was hoping to get.  I thought 21st Century did a great job for us, so I'm pretty disappointed so far with Hagerty's, a company that enjoys a pretty good reputation.

I would put up a stink over that, the other insurance co. should pay whatever the amount of damages are regardless of how old the cars is.Tell them you want the car fixed,if you are still not happy there is always arbitration or putting the word out on internet forums.  :naughty:

Some good info here. Like Tony (fishn4cuda) to me in 2007, is to insure my value for what I can replace it for not what I have in it. Looks like I'll need to find some more money somewhere to up my agreed value.

Well, its not that far away. With enough determination, you'll get your way. I dealt with Hagerty a while back. There was a point where I thought they were going to get a little squirrely with me, but we got it square and they even went above and beyond. If all they need is someone saying they'll give $16K on salvage for the car, then I'll say it! Basically, your car is going to be totalled out and taken from you because of a $3,500 gap in what someone supposedly is willing to pay. BS. It isn't going to happen that way... especially since it was the other guy's fault. Pay up sucka, you hit da man's car!

An update on the Cuda:
Hagerty came through with a little persuasion.  I pointed out that the adjuster who looked the car over left off a number of items that I had pointed out to him.  I had given him a list of all the messed up parts, their costs, and the vendors, and on his appraisal, he left a number of things off.  Hagerty sent my email to the appraiser asking him to check over the discrepancies and report back.  When he did do that, the amount got much more realistic, and I agreed to that number.  The Hagerty Claims person pointed out that I should really raise the declared value of the car to avoid hassles in the future--I will.
I got my first load of AMD sheet metal in and we are beginning to nurse the car back to health.  I first brought the car to a body shop where they "pulled" it.  They quoted me 12 hours, but I'm not convinced they spent that much time on it.
We've yanked some of the bashed up metal off and have gotten a few of the new pieces on.  Bob (4 Speed Fish on this site) and his buddy have been helping steadily and I've talked to Topcat a few times.  Hope to have it ready to at least show up at the Mopar Alley show on 6/5 and then done by mid summer.  Will post a few more pictures as progress is made.

Glad to hear that Hagerty came though for you.
I have always kept a realistic value on my cars with them. I have upped the value in the years. Not much of a premium change.

Nice to see progrees on your repairs!

I dont  understand why Hagerty is paying you ANYTHING.

If the truck hit you, shouldn't THEY be paying you?   :clueless:

Shouldnt Hagerty be just a wee bit more helpful here? I mean they are going for this specific market (40 year old cars) so they should be well versed in getting you top dollar compensation!

Typical insurance company -- they kiss your butt until you pay....then when you try to claim you are like the red headed step child.

You are making some great progress on the car. That would be great if you could make the Ohlone show with it.
