Case in point (not that this will happen to you but...)

I know of a local speed shop whose owner had fallen behind since 2008 and owed about 300-400k in rent to the landlord. This guy had all sorts of machinery and tools in the shop so the landlord wasn't so worried about getting paid. Well the landlord finally got fed up and said he was coming down in 2 weeks - out of area. The owner of the speed shop had his folks work 4 days straight 24x7 to clear out the shop before the landlord showed up.

The day the landlord showed up, there was absolutely nothing left in the shop.

True story.


To ensure that I didn't get taken, I set up a 7x milestone payment plan and work progress as agreed in the contract. At the end of it, you contract out as best you can and even with the most tenured shops you take a risk. Since I haven't seen the car in weeks and all my attempts to see the car and speak to the shop owner have been denied, is there a claim to issue a stolen vehicle report? My insurance agent thinks this the the best route.

It could happen, but I could also slip on the ice tomorrow and die. I take ricks, but only calculated. Hopefully, his son will be able to go through to him. I've given him a easy way out by simply honoring the agreement and he'll be able to receive final payment. Thanks for all the advice and support.

I am thinking, if you can, just show up un announced and have a look for your car and if the car is looking really nice and to what you have paid for, just give the guy heaps of praise to try swing him back on side and let him explain his situation to you, just show heaps of enthusiasm and big smiles, maybe he needs that kind of boost to give you a return in becoming a happy customer again, there will be a reason of some kind, just remember to be simpathetic and understanding and a new found drive could be had, it is a sharp edge sword to walk along, but smart thinking will prevail :2thumbs:

I think that's a great approach. I'd like to salvage this relationship as best as I can. I'm not trying to go for his throat. I just want to work it out and get my car safely back at home.

Go in with a posative attitude and show heaps of enthusiasm and happiness, :bigsmile: a smile is very contageous and he can not but help feel posative if you are, good luck and keep us posted to what happens please :2thumbs:

At 1pm, under the advisement of my insurance agent I left him a message that I'd have to file a stolen vechicle claim if i don't hear back from him by noon tomorrow. Afterwards I spoke to his son and he reached out to the guy's wife to try to help out. So far, no call back. He's a a bad guy, so I'm hoping that he does right by our agreement?.

I highly doubt it. In all my past dealings with him, he has always been fair and forthright. That's why his recent behavior has been so troubling.

I would go there with a  tow truck and get your car back as soon as possible.i would go to the local police and tell them what you are going to do and they should dispatch an officer to be a witness when you confront the person.Imo get rid of your  feelings and guilt for this guy.You had a business deal with this guy and nothing else.You have no idea what he is dealing with.Get your car back and deal with him later.If you paid him by credit card call the credit card company and tell them what is going on.I feel that if you don't act now this could get ugly.Good luck

Just went through this same type of situation this past spring. I have known the owner of the shop for many years and he does show car type work, even though I have seen many very nice cars come out of his shop, I never really knew how he deals in his business nor did I ever speak to any of his clients. I took him my car and gave half up front and signed contract with completion date. Made frequent stops to check on car until one day he's gone and no return calls for 2 weeks. I did call po-po, wanting to get inside to take my car, they said they cannot let me in to just take the car. I called the prosecuting attorney, I was told I will have to sue in civil court to get the car back. The kicker was if something did happen to the car, like stolen or damaged while in his possession I would have to PROVE (as in pictures and appraisals) its worth and sue for that amount. Thankfully he did contact me about 3 weeks later. I had some very nasty words with him and listened to his excuses (turns out he's an addict and went to some clinic for treatment). In the end he was 95% done and I gave him another deadline for the car being done. He went past the second completion date by a week and I was fine with that. He did finish the car I and am very satisfied with the work but I will never take another car to him ever! Unfortunately my relationship with him will never be the same. So there is nothing the po-po can do for you unless you can catch him at the shop and you have the title for the car and proof of payment for the work done so far. I would say to continue digging until you get ahold of him and get the car. I must say I do agree with 4 speed, stop making excuses for the guy and talking him up, he is doing you wrong, period!  Even if he is embarrassed about going over the completion date, he needs to man-up and face the music! I know when this happened to me I was beyond pissed. When I first saw him after 3 weeks my first urge was to punch a hole in his head.

:iagree:  Take the time to check out the shop and get an idea when he's there, and then, with title in your hand and in your name, go in and see what happens. If he's got a good reason- and I doubt it, then make arrangements to finish the car at a later date and remove it, right then and there. If you don't, the car becomes a hostage. If there's any resistance, be cool, leave and call the police and tell them what's going on and ask for their help to retrieve your property. While I hear you that he's been a good guy in the past, that was then and this is now. Good luck!

I agree with Kenny. I understand your frustration;I've been ripped off by more guys in this hobby than I can count. But until you're sure that things are going hinky, if you get police or lawyers involved or otherwise start raising hell, you'll poison that relationship permanently.

He sounds like he is trying to avoid you.. I agree to get a law involved and confront him.. Its sad that we have businesses that take advantage of customers. Let us know the outcome ...
